PROTECTION OF PERSONAL INFORMATION

 Welcome to the Sensor Networks mobile application and/or website www.sensorconnect.co  (“Website”), hereinafter collectively referred to as the “Platforms”, which are owned and operated by Sensor Networks Proprietary Limited, registration number: 2013/170601/07 (hereinafter referred to as “Sensor Networks”, “we”, “us” or “our”). We hope you enjoy making use of the Platforms. 

We take your privacy and the protection of your personal information very seriously and we have thus adopted this Privacy Policy (the “Policy”) to inform you about who we are, what personal information we collect from you and about you, and what we do with your personal information. The Policy also explains your privacy rights under the laws of South Africa, and how you can contact us and the necessary authorities to enforce those rights.

What is personal information?

We (as responsible party) process personal information of you as a visitor to the Platform and/or as a user of the services (“Services”) offered via the Platforms. 

If you acquired the use of a mobile monitoring hardware device from Sensor Networks or a reseller acting for and on behalf of Sensor Networks (the “Equipment”), you will be entitled to use the Services for the contracted period, and this Policy will apply to personal information we process in connection with your use of such Services. However, if you did not procure the use of the Equipment or the Services directly from us (or from a representative acting for and on our behalf) then this Policy will not apply to personal information which we process about you in connection with your use of the Services. Instead, the privacy policy of the person from whom you acquired the use of the Equipment and/or the Services will apply as between you and them (as responsible party) and we are, in such instances, acting on their behalf, as an “operator”. 

“Personal information” is defined in the Protection of Personal Information Act No 4 of 2013 (“POPIA”) as information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to-

(a)   information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;

(b)   information relating to the education or the medical, financial, criminal or employment history of the person;

(c)   any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;

(d)   the biometric information of the person;

(e)   the personal opinions, views or preferences of the person;

(f)   correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;

(g)   the views or opinions of another individual about the person; and

(h)   the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.

By submitting personal information to us via any means, you consent to us collecting, using, storing and disclosing personal information in accordance with this Policy.

Advertising identifiers

RE Google: To display advertisements to you that will be of particular interest to you, based on your browsing and activity history interacting with the Platforms and the Services.  These advertisements will appear on third-party websites around the web. 

RE Facebook: to display advertisements to you on Facebook or in Facebook Messenger that will be of interest to you. Facebook may collect or receive information from the Platforms and Services and other applications and websites and use that information to provide measurement services and targeted ads. LinkedIn: to display advertisements to you on LinkedIn that will be of interest to you, and by visiting or using the Website you consent to this use. LinkedIn may collect or receive information from our Platforms and use that information to provide measurement services and targeted ads

Google uses specific cookies to allow them to serve these ads around the web. You may prevent this type of advertising by deleting the appropriate Google cookie through your browser, though this may not be permanent. For a more permanent solution, you may opt out of such Google advertising by adjusting your Google ad settings or using the WebChoices online opt-out tool. If you do not want to receive Facebook advertisements, you can opt-out of such advertising by adjusting your Ad Preferences settings while logged in to Facebook. If you do not want to receive LinkedIn advertisements, you can opt-out of such advertising by following LinkedIn's instructions or using the WebChoices online opt-out tool. If you choose not to supply this information you may not get notified of the latest products and services offered by us. Online advertising networks, like Google, Facebook and LinkedIn
Analytics identifiers (for example, each time you visit the Platforms, we automatically collect (as applicable) your IP address, browser and computer or device type, access times, the web page from which you came, the web page(s) or content you access, and other related information).

Third-party analytics programs

This information is automatically collected to help us understand how our users use the Platforms and the Services, but none of this information identifies you personally, except via an alphanumeric string. We use information collected in this manner only to better understand your needs and the needs of Platform visitors and users of Services in the aggregate. Sensor Networks also makes use of information gathered for statistical purposes to keep track of the number of visits to the Platforms, the specific pages on the Platforms, and users with a view to introducing improvements to the Platforms and Services. 

Your IP address and other relevant information we collect using the Third-Party Analytics Programs may be used in order to trace any fraudulent or criminal activity, or any activity in violation of our terms of service

Mandatory to use the Platforms and the Services. If you do not provide this information you may not be entitled to use the Platforms or the Services Companies that provide data analytics, such as  HubSpot, Google Analytics, Segment and Snowflake

 

POPIA permits us to collect the above mentioned personal information about you provided that we comply with POPIA in connection with our processing thereof. In this regard:

Sensor Networks shall:

  1. Notify you should any personal information be accessed or acquired by an unauthorised person.
  2. Process your personal information lawfully. Accordingly, Sensor Networks shall only use and process the personal information for the purpose for which such personal information was collected.
  3. Use reasonable endeavours to protect your personal information and keep such information confidential (save where the disclosure thereof is permitted in accordance POPIA or this Policy).

You have the right:

  1. To request us to amend, correct or delete your personal information (save that we may reject your request to the extent that we need such information to render the Services, to comply with applicable laws or to otherwise protect a legitimate interest).
  2. To enquire about the nature and type of Personal Information which we keep in our possession and to request access thereto.
  3. To object to our processing of your personal information in accordance with section 11(3) of POPIA.
  4. To lodge a complaint with the Information Regulator as follows:
